CASE OVERVIEW: Artist Matthew C. Schoenborn created a work entitled "One Fish, Two Fish, Red Dish, Blue Dish." His work was in the final 10 pieces for ArtPrize last year and, as a result, has become quite well known. At a recent show, he was offered $10,000 by a private collector who wanted to purchase the work to put on permanent display at his lakeside art gallery. Random House, the publisher of Dr. Seuss' famous book, One Fish, Two Fish, Red Fish, Blue Fish is now suing Matthew C. Schoenborn for copyright infringement. It is your job to hear the arguments from both sides and determine whether or not Schoenborn violated copyright laws when creating the work, "One Fish, Two Fish, Red Dish, Blue Dish."
As the judge, it is up to you to know the laws regarding Fair Use and to determine whether the defendant or the plaintiff was right in their claims. Begin by taking notes about the main points of the Fair Use law and then gather information on past court cases to use as precedent in your ruling. This page will help you find both the exceptions to copyright that are allowed under Fair Use, as well as past cases that have been fought based on each exception.
Once you have written all your notes, talk to the Court Reporter and explain to him the past cases that you believe are the most relevant to the case that you are overseeing.
