To begin building your case, you will need to study Fair Use laws. Using the following link, write a brief description of the Fair Use Policy. Include each type of exception that would allow a work to fall under Fair Use and an example of each.
Once you have read and understand the information about Fair Use, use the Fair Use Evaluator to help you organize and record your argument that the Defendant's work does not fall under Fair Use. When using the Fair Use Evaluator, be sure to click on the little blue links to help you fill out the form along the way. While creating the form, also think about the ways that the defense will try to argue that the work falls under Fair Use and the arguments that you could use against that stance. Once you have completed the form, download a .pdf file for your records and to share with both the Judge and the Court Reporter. Then, move on to your final step.
